Terms and Conditions

The rules for using this site and your TrackThirtyTwo account, in language you can actually get through.

The short version

Use the site sensibly, keep your account details accurate and your password to yourself, and do not take our content and pass it around. Be over 18.

Using the site means you accept what is below. If you do not, the honest answer is to stop using it.

Who these terms are between

You, as someone using trackthirtytwo.com, and TrackThirtyTwo Ltd, who own and run it. They cover the site and its subdomains, unless one of those carries its own terms.

They do not apply to our own staff or contractors using the site as part of their work.

You need to be 18 or over. Using the site is you telling us that you are.

Our content, and what you can do with it

Everything on the site that was not uploaded by a user belongs to us or to the people we license it from: text, graphics, images, audio, video, code, layout, all of it. Copyright, trademarks and database rights apply.

You may view it on your device for your own personal, non-commercial use. That is the licence.

Beyond that, nothing gets copied, modified, redistributed or used commercially without our written permission. Nothing here grants you the right to use our name or our logo.

For downloaded files specifically, plugins, dashboards and LED profiles, the End User License Agreement is the detailed version.

What you upload, and what we do with it

Some of our software lets you share your own material with other people: Race Academy laps and the car setups attached to them, Track Rivals times, profiles you publish, anything else you choose to send us. All of it stays yours. We are not claiming ownership of it.

Only share what is actually yours to share. By turning sharing on you are confirming that you have the right to publish what goes up. Car setups are the one to watch: if you are running a setup you bought, or one a team or coach gave you under their own terms, those terms may not allow you to pass it on. Check before you share it.

So that the feature can work, you give us permission to store your shared material and show it to the people you shared it with, for as long as you leave sharing on. That permission covers nothing else. We do not sell it and we do not hand it to anyone outside the communities you chose.

You can withdraw it whenever you like. Turning sharing off in the plugin hides your shared material and stops anything new going up, and there is a control in the plugin to delete what you have already shared.

If something has been shared that should not have been, whether it is yours or you own the rights to it, email support@trackthirtytwo.com and tell us what it is and where. We will take it down while we look into it. We can also remove shared material and withdraw sharing from an account that keeps publishing other people's work.

What you must not use the site for

Anything that damages the site or gets in the way of other people using it.

Anything unlawful, abusive, harassing, threatening, or otherwise the sort of behaviour you would not want aimed at you.

Copying or storing content protected by copyright without permission from whoever owns it.

Your account

Keep your details accurate and up to date. If your email changes and we cannot reach you, that becomes a problem at exactly the moment it matters, usually billing.

We can suspend or close an account for a good reason, including a breach of these terms.

You can close yours whenever you like by telling us in writing. Once you do, stop using the site. Closing an account does not remove any statutory rights you have.

Your password

Yours alone. Do not share it, and do not reuse it from somewhere else.

If we see something that looks like misuse or a security problem, we may force a password change or suspend the account while we work out what happened. That is protection, not punishment.

Links to other sites

We link out to manufacturers, communities and tools. Those sites are not ours, we do not control them, and we are not responsible for what is on them.

A link is a pointer, not an endorsement of everything on the other end of it.

Availability, and what we do not promise

We work hard to keep the site and the plugin running, but we cannot promise either will be available without interruption, or free of every fault.

As far as the law allows, we are not liable for loss arising from use of the site. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not permit us to limit.

Your rights under the Consumer Rights Act 2015 are unaffected by anything on this page.

Buying from the store

These terms apply when you buy clothing or other goods from our store, alongside everything else on this page.

Prices. Set in pounds, and the same wherever you are. They include any VAT due on them, which for most countries outside the UK is none. Outside the UK we also show roughly what a price comes to in your own currency, at a recent exchange rate, as a guide only. Delivery is added at the cost your basket shows for your country, with any VAT due on it, before you pay. Members pay the members' price shown on each product, as long as their membership is active when they check out.

Your order. Our agreement is made when you pay and we send your order confirmation. Every piece is made after it is ordered, so how long your order takes depends on where it is going and the delivery option you choose. If it is taking longer than usual, we will tell you. Until it goes into production you can cancel it for a full refund. That can be within hours of ordering, so if you change your mind, cancel as soon as you can. If it is lost in the post or very late, tell us and we will replace it or refund you. None of this affects your legal rights.

Payment. Taken by Stripe when you place your order. We never see or store your card details. Outside the UK, Stripe's payment page usually offers to take payment in your own currency: it shows you the exact amount before you pay, at Stripe's exchange rate, which includes a conversion fee, and you can choose to pay in pounds instead. If you pay in your own currency, any refund goes back in that currency at the same rate.

Promo codes. One code per order, entered in your basket. Only codes given out for the store work in it: membership codes do not. A code comes off the items, never the delivery, and works on members' prices too. Codes have no cash value, and cannot be added to an order after it is placed.

Delivery. Worldwide, to the countries offered in your basket. Your order is delivered to the country you chose there, by the delivery option you chose, at the cost it showed. The goods are yours, and our responsibility for them ends, once they are delivered to the address you gave at checkout, so please check it before you pay. If a parcel comes back to us because the address was wrong or incomplete, or because it was not collected, we will email you. We can send it again once you have confirmed the address and paid the cost of sending it again. If you would rather not, or we do not hear from you within 14 days, we will cancel the order and refund the price of the items, but not the delivery. Delivery estimates vary by country and by option, and your basket shows them before you pay. Checkout asks for a phone number, so the courier can reach you if they need to. If your order has not arrived well after its estimate, tell us and we will chase it.

Orders delivered outside the UK. Import duties and taxes may be charged by the country your order is delivered to. They are set by that country, not by us, and they are yours to pay, unless the delivery option you chose says duties and taxes are paid, in which case they are in its price. Returns from outside the UK are posted at your cost, unless the item is faulty, as our Refund Policy explains.

Cancelling and returns. Set out in our Refund Policy. Nothing in these terms affects your statutory rights.

Store reviews
  • Only people who bought the product from us can review it. Each review is checked against its order and marked Verified buyer.
  • You can review each product once per order, as soon as it has arrived or 14 days after it was posted. We email every customer once to ask, whatever they bought, except for an order whose payment is disputed, one with nothing left to review, or one whose customer has closed their account.
  • Fake reviews are not allowed. A review must be your own honest experience of what you bought. People who work for TrackThirtyTwo do not review our products.
  • We never pay for reviews or give anything for them: no discounts, gifts or prize draws.
  • Every review is published straight away, good or bad, newest first. We never edit a review, and the average counts every review shown, each the same.
  • We only hide a review that is abusive, shares someone's personal details, is not about the product or buying it, is spam or not genuine, or that its writer asks us to take down. Its writer can see why on their order page.
  • You can add up to 3 photos of what you bought. They are published with your review, and we only remove a photo for the same reasons we would hide a review, telling you why on your order page.
  • A review is not a complaint. If something is wrong with your order, contact us and we will put it right, whether or not you review it. Leaving a review never affects your rights.
  • Think a review breaks these rules? Report it and a person will look at it.

Changes to these terms

We update these from time to time, and the date at the top tells you when we last did. Continuing to use the site after a change means you accept the updated version, so it is worth a glance if that date has moved.

Which law applies

The law of England and Wales, with disputes going to the courts of England and Wales. If the consumer law where you live gives you protections that override that, those apply.
